What changed
- Amends the Electric Utilities Act to authorize the Independent System Operator (ISO) to bring all or part of the 'REM ISO rules' into force at times it determines (s.3(6), new s.20.01(2)(f)).
- Requires the ISO to obtain the Minister's approval or notify the Minister before taking certain actions related to the suspension of REM ISO rules, as prescribed in regulations (s.3(6), new s.20.01(2)(h)).
- Authorizes the Minister, by order, to direct the ISO to end a suspension of REM ISO rules and to reinstate their application (s.3(6), new s.20.01(2)(i)).
Why it matters
- Increases direct ministerial control over the operational decisions of the Independent System Operator, particularly concerning the implementation and suspension of market rules.
- Potentially reduces the operational independence of the ISO by subjecting its actions to ministerial approval or direction.
- Shifts authority from an independent operator to the executive branch, impacting the governance structure of the electricity market.
Other governance concerns
- Ministerial discretion
- Independent oversight
