What changed
- The Minister is empowered to establish 'REM ISO rules' by regulation for the restructured energy market (s. 20.01).
- The Minister's approval is required for the Independent System Operator (ISO) to propose amendments to REM ISO rules, and the Minister can authorize the ISO to rescind inconsistent ISO rules (s. 20.01(2)(c), (e)).
- The ISO's duties are amended to include prioritizing, restricting, or varying the dispatch or pricing of electric energy during transmission constraints, subject to regulations (s. 17(b.1)).
- The ISO's obligation to plan for the removal of all transmission constraints is removed (s. 33(1)).
- The Minister gains new regulation-making authority for managing transmission constraints, including prioritizing/restricting dispatch/pricing, and for establishing REM ISO rules (s. 41(a.3), (a.5)).
Why it matters
- Centralizes significant control over Alberta's electricity market operations and rule-making from the Independent System Operator to the Minister.
- Reduces the operational independence of the ISO in setting and amending market rules, as ministerial approval becomes paramount.
- Allows for direct ministerial influence over electricity dispatch and pricing during transmission constraints, potentially impacting market fairness and efficiency.
- Alters the ISO's long-term planning mandate for the transmission system, potentially affecting future grid reliability and expansion.
Other governance concerns
- Ministerial override of independent body's rules
- Reduced independence of market operator
- Potential for political influence on market operations
