Bill 51 — Ministerial Authority over School-Municipal Joint Use and Planning Agreements

Amends the Education Act to grant the Minister of Education new regulation-making authority over joint use and planning agreements between school boards and municipalities.

What changed

  • Section 53.1 of the Education Act is amended to allow the Minister to make regulations respecting criteria, requirements, and exemptions for joint use and planning agreements (s. 14(e), new s. 53.1(8)).
  • The bill clarifies that some municipalities may be exempt from entering into such agreements by regulation (s. 14(e), new s. 53.1(7)).

Why it matters

  • Centralizes decision-making authority regarding school-municipal land use and planning agreements with the provincial Minister.
  • Reduces the discretion and autonomy of individual school boards and municipalities in negotiating and managing these agreements.
  • Establishes a provincial standard that can displace local discretion in these matters.

Other governance concerns

  • Local governance
  • Provincial oversight
