Bill 39 — Ministerial Approval for Legal Foundation Grants (Legal Profession Act)
Bill 39 introduces a requirement for the Foundation under the Legal Profession Act to obtain ministerial approval for funding commitments or grant agreements exceeding $250,000.
What changed
- The Foundation's board, previously able to apply funds 'in any manner the board may decide,' now requires ministerial approval for funding commitments or grant agreements over $250,000.
- The Minister may, by order, exempt specific or classes of funding commitments or recipients from this approval requirement.
- Transitional provisions void any such funding commitments made between first reading and Royal Assent without the new approval.
Why it matters
- Centralizes decision-making authority by giving the Minister oversight over significant financial decisions of the Foundation.
- Reduces the autonomy of the Foundation's board in allocating funds for its objects.
- Introduces a new layer of government control over an entity related to the legal profession.
Other governance concerns
- Reduced institutional autonomy
- Increased political influence over funding decisions
