What changed
- Introduces a new 'registration' requirement for private vocational training providers, alongside existing licensing, with the Director having powers to register, refuse, and impose conditions (s. 10.1, 10.2).
- Grants immunity from legal action and compulsory testimony for the Minister, Director, inspectors, and other authorized employees acting in good faith (s. 3.1).
- Expands inspector powers to remove and retain records if necessary to preserve or protect them (s. 15(b)(d)).
- Allows the Director to apply for interim injunctions without requiring a bond or proof of irreparable harm, with a presumption that enforcement of the Act is favoured (s. 23.1).
- Authorizes the Director to issue directives and guidelines for interpreting or applying the Act and regulations, which are not subject to the Regulations Act (s. 23.3).
- Suspends registration or licence if Director's approval is not received prior to a change in control of a corporate registrant (s. 10.4(2), 13.1(2)).
Why it matters
- Centralizes significant regulatory and enforcement authority in the Director of Private Vocational Training, increasing executive discretion.
- The immunity provisions for officials may reduce accountability for actions taken under the Act.
- Bypassing the Regulations Act for directives reduces transparency and public input in policy development for vocational training.
- The expanded powers for interim injunctions and the presumption in favour of enforcement may limit judicial discretion and due process for institutions.
- The 'change in control' provisions give the Director significant influence over the governance of private vocational training institutions.
Rights affected
- Due process — Fair procedure before rights are restricted by the state.
Other governance concerns
- Reduced accountability for officials
- Executive discretion over regulatory process
- Due process concerns in enforcement
- Impact on institutional autonomy
