Bill 21: Expanding Ministerial Authority in Emergency Management
Amends the Emergency Management Act to centralize ministerial authority over local emergency declarations and responses, including assuming local powers and altering compensation obligations.
What changed
- Empowers the Minister to amend or cancel a local authority's declaration of a state of local emergency (EMA, s. 22(2), (3.2)).
- Allows the Minister, by order, to assume control of any or all powers of a local authority during a state of local emergency (EMA, s. 24(1.011)).
- Requires local authorities to report to the Minister any information required regarding states of local emergency, disasters, or emergency planning (EMA, s. 11.21).
- Removes the application of the Regulations Act to certain ministerial orders made during emergencies (EMA, s. 22(6)).
- States the Minister has no obligation to pay compensation for property acquired, utilized, damaged, or destroyed under the Forest and Prairie Protection Act during an emergency (EMA, s. 19(3.1)).
- Clarifies that local authorities remain responsible for compensation unless the Minister, by order, assumes responsibility or reimburses (EMA, s. 24.1).
